Slow Down
Just because an outpatient has not been submitted to hospital, doesn’t mean that you need to rush them through the door with a treatment. Upon meeting the requirements put forth by the state licensure, a new ambulatory surgery center (ASC) must also meet the CMS Conditions for Coverage. Kevin Calisher notes that these conditions will be published in the Operations Manual published by the CMS and that they must be met in order to apply for Medicare Certification. This is a requirement for all ASCs, and involves the following procedures.

  1. Upon determining the state licensure law, you must make sure that the ASC is created to be a distinct entity that operates solely in relation to surgical services for outpatients. This can be as a freestanding facility or under the control of an owner or hospital and interpretation of this regulation will vary between states.
  2. A range of specific conditions outlined by the CMS must be met. These relate to the certifications that are owned by the ASC staff members, the safety of the facility, how medical records are kept and a host of other conditions. A comprehensive list will be found in the previously mentioned Operations Manual, though it is often a good idea to bring in a consultant who is aware of the requirements in order to streamline the process.
  3. All ASCs must meet the requirements set out by the Federal and State Fire Safety Codes, in addition to a host of other building regulations on both the state and federal levels. Be aware of what codes that the building itself needs to comply with and ensure that it has relevant emergency equipment as outlined by the guidelines.
